00:10
all right
00:10
good day everyone and welcome to bright
00:12
light news um i’m tanya cazale and we
00:15
are honored to have as our
00:17
very first guest the esteemed canadian
00:20
constitutional lawyer
00:21
rocco golotti so welcome rocco and thank
00:24
you so much for joining us today
00:28
um now rocco can you just tell us a
00:29
little bit about yourself and what you
00:31
do
00:32
oh well i’m not used to talking about
00:35
myself
00:36
i’ve i’ve been i’m i’ve been practicing
00:38
law for 31 years
00:40
i’m a constitutional lawyer i only do
00:44
cases against the government
00:46
and i’ve done some doozies in my career
00:49
i
00:49
i single-handedly uh constitutionalize
00:51
the supreme court in the nade on
00:53
reference
00:54
i challenge justice nadan’s seat on the
00:56
supreme court
00:57
which ended in a 7-0 decision that said
01:00
that
01:01
if they can’t do anything to the supreme
01:03
court without the unanimous consent of
01:05
all 10 provinces
01:07
i uh in nine in 2012 i had
01:10
17 federal court judges fired who were
01:13
sitting per diem past the age 75
01:15
a practice a corrupt practice that had
01:17
been going on
01:18
since 1927. in 1999 i was co-counseling
01:23
a case called baker that rewrote
01:25
administrative law
01:27
that decided that anytime a government
01:30
official
01:31
made a decision that affected your life
01:33
for livelihood
01:34
they had to give you written reasons
01:36
prior to that they could just say no and
01:38
they’re not required to give you reasons
01:40
so you can never go to court when the
01:42
government denied you something because
01:43
you have no basis to go to court so
01:45
that’s the kind of work i do
01:47
it’s mostly it’s it’s mostly superior
01:49
court and appellate court and supreme
01:51
court work
01:52
you know i’m a former bencher of the law
01:54
society i’ve been
01:55
named twice one of the top 25 lawyers in
01:58
the country by canadian lawyer magazine
02:00
and in 2015 i was a recipient of the
02:04
uh ontario bar association’s
02:07
president president’s award which is the
02:09
most prestigious award given by members
02:11
of the park
02:12
i was the first lawyer to get that prior
02:14
to me getting that award
02:15
only judges and organizations had been
02:18
recipients so i was the first lawyer to
02:20
get that award
02:21
can we start with what the role of the
02:23
government is so
02:24
governments while they’re supposed to
02:27
reflect
02:28
the will of their citizens and the
02:31
democratic process and protect
02:34
their citizens spend most of the time
02:38
doing the opposite governments need to
02:40
be feared and mistrusted
02:42
and i mean a lot of constitutions that’s
02:44
why they have
02:45
bills of rights and charter of rights
02:47
the charter of right
02:49
is there to protect the citizens of
02:51
canada against the government
02:54
that’s why it’s there if governments
02:57
didn’t commit these atrocities against
02:59
their own citizens
03:00
we wouldn’t need a charter of rights
03:03
okay
03:05
right thank you now rocco can you tell
03:08
me which
03:09
constitutional rights and freedoms have
03:11
been violated
03:12
well how long is this broadcast first of
03:15
all
03:15
first of all first of all
03:19
they have violated the constitutional
03:22
right that’s been in place since 18
03:26
1688 under the english bill of rights
03:28
which is read into our constitution
03:30
of dispensing with parliament under the
03:33
pretense of royal prerogative
03:35
so they’re they’re they’re governing now
03:38
through ministerial
03:39
and cabinet orders and they’ve basically
03:41
dispensed with parliament
03:43
number one constitutional infringement
03:45
and that’s structural that’s not under
03:47
the charter they can’t do a section 33
03:49
ever
03:49
override or claim reasonable limit on
03:52
the section one of the charter that is a
03:53
structural breach
03:55
that they cannot uh cure
03:58
number two they’ve they’ve
04:01
uh relinquished the duty to govern by
04:04
dispensing a parliament which is another
04:06
constitution structural constitutional
04:07
breach
04:09
number three they’ve abused their
04:11
authority because if you look at the
04:13
legislation in ontario for existence the
04:16
example in order to call an emergency
04:19
you have to have two prerequisites
04:21
they didn’t meet the two prerequisites
04:23
so they’re acting illegally
04:25
totally renegade uh
04:28
so past that the measures breach
04:32
the charter of rights sections 2
04:35
7 8 9 and 15.
04:39
under section 2 they breached the right
04:41
of freedom of
04:42
freedom of association freedom uh
04:46
freedom of thought conscience
04:49
expression uh under section seven they
04:52
breached
04:53
section seven of the charter to life
04:55
liberty and the security of the person
04:57
which which includes being
05:01
hampering the way you pampering your
05:03
breathing literally
05:05
and telling you how to breathe without a
05:08
master with a mask
05:10
uh they’re gonna infringe your section
05:12
seven rights when they bring in
05:14
mandatory vaccination under section
05:17
eight
05:17
they engaged in unlawful and
05:20
unreasonable search and seizure of
05:22
businesses by ordering them closed
05:24
so ma and post hardware stores
05:28
clothing stores shoe stores were closed
05:31
but walmart and costco
05:34
got to sell everything under the sun
05:36
just because they were selling a bit of
05:38
food in the corner that makes no sense
05:40
to me that’s an unreasonable search and
05:42
seizure
05:42
of the mom and paw independent
05:44
businesses by the way
05:46
uh the association of independent
05:48
businesses in british columbia just
05:49
announced that
05:50
21 000 businesses in british columbia
05:54
alone
05:54
have closed down as a result of the
05:56
coveted measures meanwhile the big
05:58
the the multi-national corporations are
06:02
doing a booming business
06:03
which is part of this agenda they also
06:07
are infringing section 9 of the charter
06:09
by these are
06:11
against arbitrary detention
06:14
by these by-law enforcement officers
06:17
who are enforcing illegal
06:21
who are illegally enforcing the law so
06:23
for instance the masking law
06:25
all the masking laws say that you have
06:28
you should wear a mask unless you’re
06:30
exempt
06:32
so when people invoke an exemption that
06:35
exemption
06:36
is not being respected so the people who
06:39
don’t respect the
06:40
exemption are in fact breaking the law
06:44
and so when a bylaw officer or police
06:46
officer
06:47
detains you or even a store person
06:49
detains you arbitrarily
06:51
and furthermore is not respecting the
06:53
exemption in the law
06:54
that’s an arbitrary detention contrary
06:56
to section 9 of the charter
06:59
then you have a vicious ugly vile
07:02
depraved
07:03
infringement of section 15 of the
07:05
charter with respect to two
07:07
vulnerable groups the physically and
07:10
neurologically disabled whether they be
07:12
adults or children
07:14
and the aged senior citizens so
07:18
the physically and neurologically
07:20
disabled including
07:22
and especially children with special
07:24
needs
07:26
while they protect they’ve imposed the
07:28
general lockdown and covert measures on
07:31
them
07:31
they have made absolutely no provision
07:34
to help these poor kids and these poor
07:36
adults
07:37
and they’re left out there to to
07:40
vanquish
07:41
do you think a severely autistic child
07:45
knows how to enter
07:46
[Music]
07:48
do you think a mentally disabled adult
07:51
knows
07:52
or can adhere to these measures they
07:54
have not accommodated them
07:56
they have not accommodated them by
07:58
putting in measures that
08:00
keep up their social contacts their
08:03
places to go and get therapy
08:06
and all of that that is very vicious and
08:08
very severe
08:09
and of course given that 84
08:12
of all people who died from the povid
08:14
died in
08:15
long-term term care facilities their
08:18
equality rights to be protected under
08:20
this so-called pandemic
08:22
have been severely breached with the
08:24
with the
08:26
uh uh vast vast bulk of the
08:30
impact falling on them so those are the
08:32
charter rates that have been breached
08:54
you
